1. Eligibility

You must be at least 18 years old to use FertiBites. By using the app, you confirm that you are 18 or older and have the legal capacity to agree to these Terms.

2. What FertiBites Provides

FertiBites uses AI to provide educational food and nutrition guidance related to fertility, pregnancy, and food choices. The app may analyze food photos, text questions, voice inputs, user preferences, allergies, dietary restrictions, and foods you choose to log.

FertiBites is intended to support safer and more informed food-related decisions. It is not a substitute for professional medical care.

3. Medical and Nutrition Disclaimer

FertiBites provides educational information only.

FertiBites does not provide medical advice, diagnosis, treatment, emergency guidance, or professional nutrition counseling. You should not rely on FertiBites as the sole basis for health, medical, pregnancy, fertility, allergy, medication, substance, or nutrition decisions.

Always consult your healthcare provider, registered dietitian, pharmacist, or another qualified professional for guidance specific to your health, fertility journey, pregnancy, allergies, medical conditions, medications, or nutrition needs.

If you may be experiencing a medical emergency, allergic reaction, poisoning, drug exposure, severe symptoms, or urgent health concern, contact emergency services, poison control, or a qualified healthcare provider immediately.

4. AI Limitations

FertiBites uses artificial intelligence. AI can make mistakes.

Outputs may be inaccurate, incomplete, outdated, overly cautious, not cautious enough, or inappropriate for your personal situation. Food safety and nutrition guidance can depend on details the app may not know, including preparation method, portion size, gestational status, health history, allergies, medications, local food safety conditions, and advice from your healthcare provider.

You are responsible for reviewing FertiBites outputs carefully and using your own judgment.

5. User Information, Allergies, and Preferences

You may provide information such as your name or nickname, fertility or pregnancy stage, allergies, sensitivities, dietary restrictions, foods you avoid, food photos, text questions, voice inputs, and food decisions.

You are responsible for ensuring the information you provide is accurate and current. FertiBites may use this information to tailor future food and nutrition guidance, but it cannot guarantee that every allergy, preference, restriction, or risk will be identified in every result.

Do not enter information that you do not have the right to provide.

6. Subscriptions and Payment

FertiBites may offer auto-renewing subscriptions through Apple In-App Purchase.

Current subscription options may include:

• Monthly subscription: $9.99 USD per month
• Yearly subscription: $49.99 USD per year

Actual pricing may vary by country, currency, taxes, exchange rates, App Store settings, promotional offers, and Apple's pricing tiers. The final price will be shown in the App Store purchase flow before you confirm payment.

Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account may be charged for renewal within 24 hours before the end of the current period.

You can manage or cancel your subscription through your Apple ID account settings. Refund requests, billing issues, and cancellation processing are handled by Apple according to Apple's policies.

7. Free Trials, Promotions, and Access Limits

FertiBites may offer free trials, free usage limits, promotional access, or testing access. We may modify, limit, or end these offers at any time where permitted by law.

We may also change app features, subscription benefits, usage limits, or availability over time.

8. App Store Terms

Your use of FertiBites is also subject to Apple's applicable App Store terms, including Apple's Standard End User License Agreement if applicable. Apple is not responsible for providing support or maintenance for FertiBites.

9. Acceptable Use

You agree not to:

• Use FertiBites for emergency medical decisions
• Use FertiBites as a substitute for professional medical advice
• Misrepresent information you provide to the app
• Attempt to reverse engineer, copy, modify, or interfere with the app
• Use the app to generate harmful, illegal, abusive, or misleading content
• Attempt to bypass subscriptions, usage limits, security systems, or access controls
• Upload content that infringes another person's rights or violates applicable law

10. User Content

You retain ownership of content you submit, such as photos, text, voice inputs, preferences, and food decisions.

You grant Conatus Labs Inc. a limited license to process, store, analyze, transmit, and display your content as needed to operate, improve, secure, and support FertiBites, subject to our Privacy Policy.

11. Privacy

Your use of FertiBites is also governed by our Privacy Policy. The Privacy Policy explains how we collect, use, store, and share information.

12. Third-Party Services

FertiBites may rely on third-party services for functions such as AI processing, transcription, analytics, subscriptions, crash reporting, infrastructure, or app distribution. These services may process information as described in our Privacy Policy.

We are not responsible for third-party services that we do not control.

13. Availability and Changes

We may update, modify, suspend, or discontinue FertiBites or any feature at any time. We do not guarantee that the app will always be available, error-free, uninterrupted, or compatible with every device or region.

14. No Warranties

FertiBites is provided "as is" and "as available."

To the fullest extent permitted by law, Conatus Labs Inc. disclaims all warranties, express or implied, including warranties of accuracy, reliability, merchantability, fitness for a particular purpose, non-infringement, availability, and suitability for medical, fertility, pregnancy, allergy, or nutrition decisions.

15. Limitation of Liability

To the fullest extent permitted by law, Conatus Labs Inc. and its directors, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of data, profits, goodwill, health outcomes, or other intangible losses arising from your use of FertiBites.

To the fullest extent permitted by law, our total liability for any claim related to FertiBites will not exceed the amount you paid to use FertiBites in the 12 months before the claim, or $100 USD if you did not pay for the app.

Some jurisdictions do not allow certain limitations of liability, so some of these limits may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless Conatus Labs Inc. and its directors, officers, employees, contractors, and affiliates from claims, damages, liabilities, costs, and expenses arising from your misuse of FertiBites, violation of these Terms, violation of law, or infringement of another person's rights.

17. Termination

We may suspend or terminate your access to FertiBites if you violate these Terms, create risk for the app or other users, or use the app in a way that may cause legal, security, or operational harm.

You may stop using FertiBites at any time. Subscription cancellation must be handled through your Apple ID account settings.

18. Governing Law

These Terms are governed by the laws of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute related to these Terms or FertiBites will be handled in the courts located in Ontario, Canada, unless applicable consumer protection laws require otherwise.

19. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may notify you through the app or by other reasonable means. Your continued use of FertiBites after updated Terms become effective means you accept the updated Terms.
